The New Approach program, launched in 1985 in European Union countries, has been implemented to ensure the lowest level of product safety and facilitate the free movement of products within a single market.

The New Approach Directives relate to a number of fundamental requirements in the areas of safety, health, the environment and consumer protection. Community-level regulations, which must be transposed into national laws in all countries within the European Union, provide a set of basic requirements, with the addition of a visual symbol to indicate that a product complies with the CE mark. These directives are based on harmonized European Union standards and technical approval guidelines, which translate basic requirements into technical specifications.

The CE marking is therefore a mandatory mark for all products covered by one or more directives. The CE marking is a mandatory and visible marking that products may be placed on the market within the European Union. Indicates that the manufacturer or the company responsible for placing the product on the market first approves the conformity system to ensure that the product complies with all the guidelines contained in the relevant directive or directives. These principles are based on security, human health and consumer protection.

In the CE certification system, the commitments of the European Union countries are as follows:

  • Check whether the manufacturer is justified in placing products on the market in accordance with the essential requirements of the directive or directives

  • Ensuring the free movement of products bearing the CE mark in the country, regardless of origin

Each of the directives describes the means by which a product must demonstrate compliance with basic requirements. Depending on the nature of the risks present in a product, the CE marking is added as follows:

  • Under the responsibility of the manufacturer, or

  • Following conformity assessment and conformity tests, type testing, production control and quality assurance by a third party (notified body), depending on the product group

Eventually, all products except drugs, chemicals, cosmetics and foodstuffs have to bear the CE Mark.

For example, the Construction Materials Directive 305 / 2011 / EU contains legal, regulatory and administrative regulations for building products within the European Union and is a directive for the harmonization of the requirements for construction works. With the publication of this directive, the free movement of construction products in European Union countries has been facilitated and a high level of safety and health guarantee has been provided for end users. It specifies the general basic requirements and describes the harmonized technical specifications for the properties required for construction products. The Construction Materials Directive therefore ensures that construction products offered to the European Union markets are suitable for their intended use and meet the basic requirements of the construction works in which they are used.

The basic requirements for building materials are: mechanical resistance and stability, safety in case of fire, hygiene, health and environment, safety of use, noise protection and energy economy and heat retention. These requirements must be met for an economically reasonable working life of the building materials.

Within the framework of the New Approach Directives, the European Commission has defined the conformity assessment system for each product feature and intended use. Conformity assessment extends from the declaration of conformity of the manufacturer to the notified body certification. In any case, however, the manufacturer is responsible for the CE marking attached to the products and all relevant information and documents.
